Court Of Protection Solicitor

About the role

Our client is a specialist law firm recognised by Legal 500 and Chambers & Partners. They are seeking a senior Court of Protection Solicitor to join their London team, handling complex mental capacity welfare matters and contributing to the growth of a market‑leading department.

Key responsibilities

• Manage Mental Capacity Welfare cases in the Court of Protection from instruction to conclusion.
• Advise clients on health and welfare decisions, best interests, deprivation of liberty and related issues.
• Handle Community Care and Judicial Review matters linked to mental capacity.
• Draft pleadings, statements and legal submissions.
• Liaise with the Official Solicitor, local authorities, healthcare providers and other professionals.
• Maintain case files in line with Lexcel and firm procedures.
• Ensure compliance with SRA standards, Legal Aid Agency regulations and internal policies.
• Supervise, mentor and provide technical guidance to junior team members.

Required profile

• Qualified Solicitor or FILEX with at least 4 years PQE in Mental Capacity law.
• Strong experience handling Health and Welfare cases in the Court of Protection.
• Member of the Law Society Mental Capacity (Welfare) Accreditation Scheme, or working towards accreditation.
• Experience with legally aided matters and familiarity with LAA requirements.
• Excellent client‑care and communication skills.
